MINUTES OF SELECTMEN MEETING –  November 5, 2012 5:00 PM

Minutes of the previous meeting were read and accepted.

Susan Moore, speaking on the behalf of Audrey Miller, stated that the communication between WPOA and Tolland Officials during hurricane Sandy were better then previous storms.

Susan Moore, President of The WPOA, informed the Selectmen that the installation of the dry hydrant at Otter Pond could not go forward without further approvals from the Tolland Conservation Commission and the MA DEP according to communications from Mark Stinson of the DEP.
The WPOA was doing this installation for the Tolland Fire Department who requested the original NOI with Conservation.

The WPOA has the most of pipe and fittings that will be needed for the hydrant, and if this location does not work out then they will most likely be able to donate it to the fire department for a different location in the area.

The Board of Selectmen will inform Fire Chief, Michael Sullivan.  

Phil Grannan stated that the Board of Selectmen will hear in writing from the Commonwealth of Massachusetts on the results of the MassWorks Infrastructure Program. The grant application was written for the repairs of route 57.

A Special Town Meeting has been scheduled for Monday, November 26th at 7PM. The Special Town Meeting Warrant was reviewed and signed.

The Board of Selectmen received a letter of retirement from Wayne Carr, Highway Superintendent; Wayne will be retiring as of December 31, 2012.

The Highway Superintendent’s position will be discussed at a working Board of Selectmen’s meeting for Tuesday, November 13, 2012 at 5PM.

The Selectboard discussed the option of hiring a seasonal employee for the upcoming winter months or until the Highway Superintendent is hired. The seasonal employee will be paid a rate of $15/hourly with no benefits.

Eric Roddy, of CTC Electric, LLC (d/b/a Brightridge Solar) (collectively, “Brightridge”) is developing a proposed 3.8 megawatt photovoltaic solar facility (the “Facility”) on property located at 1403 New Boston Road, Tolland, Massachusetts that is owned by Deming Family Nominee Trust (the “Owner”).
In order to establish an accurate projection of the expenses with respect to the real and personal property associated with the Facility that is taxable under law, Brightridge is seeking to enter into an agreement with the Town of Tolland, Massachusetts (the “Town”) to establish a Payment in Lieu of Taxes for Real Property and Personal Property therefore (the “PILOT Agreement”).

CTC Electric, LLC (d/b/a Brightridge Solar) and its project development affiliate entities (collectively, “Brightridge”) are developing a proposed 3.8 megawatt photovoltaic solar facility (the “Facility”) on property located at 1403 New Boston Road, Tolland, Massachusetts.

Electricity produced by the Facility will be interconnected to the Western Massachusetts Electric Company’s (“WMECO”) distribution system pursuant to WMECO’s Standards for Interconnecting Distributed Generation (M.D.P.U. No. 1039E) (the “Interconnection Standards”) and will receive value for the electricity produced in the form of net metering credits from WMECO pursuant to WMECO’s Net Metering Tariff (M.D.P.U. 1048D) (the “Net Metering Tariff”).

Brightridge has arranged for the sale of net metering credits produced by the facility to two regional municipalities, with one of these municipalities contracted to purchase net metering credits produced by a portion of the facility representing approximately 2.2 megawatts, and the other agreeing to purchase net metering credits produced by the remaining 1.6 megawatts.
In order for the above-referenced sales of net metering credits to comply with new net metering regulations taking effect pursuant to Massachusetts Department of Public Utilities’ (“DPU”) recent Order on Definitions of Unit and Facility (D.P.U. 11-11-C), Brightridge is seeking a Net Metering Credit Allocation Agreement (“NMC Agreement”) with the Town of Tolland, Massachusetts (the “Town”), whereby the Town would act as the Host Customer (as defined in the Net Metering Tariff) of the Facility in exchange for an allocation of net metering credits produced by the Facility
